About us
The European Union Intellectual Property Office (EUIPO) is the European Union Agency responsible for the registration of the European Union trade mark (EUTM) and the registered Community design (RCD), two unitary intellectual property rights valid across the EU-27. EUIPO also hosts the European Observatory on Infringements of Intellectual Property Rights, which has responsibility for a wide range of tasks related to research, communication, spreading best practice and enforcement of all types of intellectual property rights. EUIPO also maintains and manages a single publicly accessible online database of orphan works. Together with its national and regional EU IP office partners, EUIPO has worked to provide a set of common IT tools and databases ranging from search and classification tools, modern electronic services for users, examination and processing software and enforcement tools. Through the EUIPO Academy, the Office offers webinars, learning materials and specific courses covering all aspects of trade mark and design registration. EUIPO has been based in Alicante, Spain, since its foundation in 1994. This is the official Linked In page of the European Union Intellectual Property Office (EUIPO). The EU has just adopted new rules that will improve and strengthen the protection of geographical indications (GIs) for wine, spirit drinks and agricultural products. GIs are an important intellectual property right granted to products that have a specific link to the place where they are made. They not only guarantee quality, but also enable consumers to trust and distinguish quality products, helping producers to market their products better. Who’s up for a ride 🚴🚴🚴? This month, some of our colleagues are swapping their car for a bike to commute to work. They are taking part in Velomai (vélo = bicycle, mai = May), an initiative that aims to encourage staff from all EU institutions, bodies and agencies to cycle more often. Through the whole month of May, participants register their rides/kilometres travelled and compete for a prize. Cycling is not only a healthy habit, but it is also cheaper and a greener alternative to other forms of transport. IP Case Law | In R 1033/2023-2, DUTCH GENQUILA / TEQUILA, the EUIPO Board of Appeal (BoA) annulled the examiner's decision to the extent that the opposition was rejected for wine. The BoA finds similarities between the contested mark ‘DUTCH GENQUILA’ and the protected GI ‘TEQUILA’, particularly the shared ending ‘QUILA’, which reinforces the association with the protected GI. It also considers that the relevant EU consumer is likely to establish a sufficiently clear and direct link between the contested sign which is applied for wine and the spirit drink protected by the PGI ‘TEQUILA’.
